The Site is managed and maintained by LAV’S s.r.l., with registered office in Località Sille 7, 38045 Civezzano (TN), Italy, and operating headquarters in Via Santorre di Santarosa 1, 10131Turin, Italy, VAT no. 02370890226, REA number TN-219508, subscribed share capital €35,000.00 fully paid up. LAV’S provides the content and services available on the Site under the terms set out in these terms of use (“Terms of Use”). By accessing or using the Site, you acknowledge that you have read, understood and accepted, without any limitation or reservation, these Terms of Use and that you are bound by them.

1. Privacy
Users are kindly requested to consult the Website’s Privacy Policy in order to obtain information on how users’ personal data is processed.
LAV’S Srl has great respect for the privacy of its Users. The data that will be communicated by the User to LAV’S Srl through the Site will be treated with the utmost care and with all the tools necessary to ensure its security, in full compliance with the Italian legislation in force to protect confidentiality.
In order to allow the activation of specific functions, the Site may in some cases use so-called cookies. The User may, at his/her own choice, be informed about the use or prevent the use of such tools by modifying the options relating to his/her navigation program.

2. Products and services
The products, services advertised on the Site and any promotional samples offered by LAV’S Srl through the Site are for personal use only. You are not permitted to sell or resell any products, services or promotional samples of products you may have received. LAV’S srl reserves the right, with or without notice, to terminate or reduce any supply of products or services if, at its discretion, it has reason to believe that the conduct of the user may result in violation of these Terms of Use.

3. Correctness of information
LAV’S Srl intends to describe its products on the Site as accurately as possible, however, to the extent permitted by law, we cannot guarantee that product descriptions, colors, related information or other content available on the Site are complete, accurate or error-free.

4. Intellectual property rights
All information and content available on the Site, including, without limitation, trademarks, logos, images, text, graphics, icons, animated sound sequences, databases, software and the compilation and organization thereof (“Content”), are the property of LAV’S Srl, its affiliates, its partners, or licensees, and are protected by applicable law.
Except as provided for in Paragraph 5, and within the limits of applicable law, any use, reproduction, copying, sale, resale, access, modification, or other type of exploitation, for any purpose, of the Content or parts of the Site is prohibited without the express prior written consent of LAV’S Srl.

5. License to use the Site and Content
LAV’S Srl grants users a non-exclusive, revocable license for personal use of the Site and Content. This license does not include the right to: (a) create frames or use framing techniques of the Site or any part of it; (b) republish, redistribute, transmit, sell, license and download the Site or all or part of the Content (except for caching or operations strictly necessary for viewing the Site); (c) use the Site or all or part of the Content for purposes other than personal; (d) modify, reverse engineer or create derivative works based on the Site or all or part of the Content; (e) collect account information for the benefit of you or any third party; (f) use meta tags or any other hidden text file that uses all or part of the Content; or (g) use spyware, crawlers or similar information gathering and extraction tools, or otherwise act in such a way as to place an unreasonable or excessive burden on the information technology infrastructure of the Site. The user is obliged to maintain, without modifying it, any proprietary communication posted on, or contained in, the Site.
LAV’S Srl also grants users a non-exclusive, revocable license to create a hyperlink to the home page of the Site solely for personal and non-commercial purposes. An Internet site that makes such a hyperlink: (i) may create a link, but not reproduce, the Content or any part thereof, without prejudice to paragraph (vi) following; (ii) does not in any way imply any recommendation by LAV’S Srl of such website or its services and/or products; (iii) may not misrepresent its relationship with LAV’S Srl; (iv) not contain messages that may be construed as unpleasant, obscene, offensive or otherwise unlawful or inappropriate for any age; (v) may not portray LAV’S Srl, or its products or services, in an untrue, misleading or otherwise offensive manner, nor associate LAV’S Srl with products, services or opinions that may in any way be unpleasant; and (vi) may not make hyperlinks to other pages of the Site other than the home page.
LAV’S Srl may, at its own discretion, request the removal of any hyperlink to the Site and, upon receipt of such request, the user must immediately remove such link and discontinue all related activities.
Any unauthorized use of the Site or all or part of the Content, as well as the creation of hyperlinks from other sites in violation of the foregoing, will automatically result in the termination of the licenses referred to in this paragraph, without prejudice to any other action to protect the rights of LAV’S Srl under the law or these Terms of Use.

6. Obligations and responsibilities of the user
In accessing or using the Site, you must comply with these Terms of Use and the specific warnings or instructions published on the Site. You must always act in accordance with the law, commercial practices and in good faith. The user may not modify or otherwise alter the Site, the Content and/or the services that may appear on the Site and may not damage in any way the integrity or operation of the same. Without prejudice to the other provisions of these Terms of Use, if the user intentionally or negligently fails to comply with the obligations set forth in these Terms of Use, he will be liable for any loss or damage that may result from such conduct to LAV’S Srl, its affiliates and its partners or licensees.

LAV’S Srl is not responsible for the content of any page outside the Site or other websites to which or from which there are hyperlinks. The hypertext links on the Site are for courtesy only and do not imply in any way that LAV’S Srl, its affiliates or its partners approve the content, products or services provided therein or their suppliers. LAV’S Srl is in no way responsible for the actions, content, products or services of these pages and websites, including, without limitation, their privacy policies and conditions of use. LAV’S Srl suggests that you carefully read the terms of use and privacy policies of the pages and websites visited by the user.

8. Specific features, functionalities and initiatives
The Site may offer specific features and functionalities or initiatives (such as contests, sweepstakes or other initiatives) that might (a) be subject to terms, conditions and rules of use in addition to or in place of these Terms of Use; and (b) be offered by LAV’S Srl or by third parties. In this case, LAV’S Srl will give notice of such initiatives and, if the user decides to join, accepts that they are subject to these terms, conditions and specific or additional rules.

9. Contributions
Generally LAV’S Srl declines suggestions or ideas not specifically requested to be submitted to it (“Contributions” or “Contribution”). By transmitting or uploading a Contribution, the user acknowledges to LAV’S Srl the non-exclusive right, valid throughout the world, to copy, use, reproduce, modify, adapt, translate, publish, license, distribute a Contribution, for the entire duration of its protection, in any manner deemed appropriate, including, without limitation, copying in whole or in part, creating derivative works, distributing and publishing Contributions in any form, medium or technology known or yet to be developed, and using the Contributions, either alone or as part of other works, in whole or in connection with its products or services. The user acknowledges that LAV’S Srl may use the Contributions without any cash or other consideration for any purpose, including, but not limited to, the development, production, distribution or marketing of products.
The user is and will be entirely responsible for the content of any Contribution transmitted to the Site.

10. User Content
When the user transmits, uploads, sends by e-mail or otherwise makes available on the Site Contributions, data, texts, software, music, graphic symbols, sounds, photographs, videos, images, messages or other materials protected by copyright or other rights (“User Content” or “User Content”) the user grants to LAV’S Srl the non-exclusive right, valid throughout the world, to copy, use, reproduce, modify, adapt, translate, publish, license, distribute User Content, for the entire term of its protection, in any manner it deems appropriate, including, without limitation, copying in whole or in part, creating derivative works, distributing and publishing User Content in any form, medium or technology known or yet to be developed, and using User Content alone or as part of other works, together with or in connection with its products or services. The user acknowledges that LAV’S Srl may use the User Content without any monetary or other compensation for any purpose, including, but not limited to, the development, production, distribution or marketing of products.
The user is and will be entirely responsible for the content of any User Content transmitted to the Site.
You agree not to transmit or induce others to transmit, upload, email or otherwise make available on the Site any User Content (a) is unlawful, harmful, threatening, defamatory, obscene, pornographic, libelous, invasive of another’s privacy, or racially, ethnically or otherwise prejudicial; (b) is false, incorrect or otherwise misleading; (c) for which you have received a fee from, or paid to, a third party; or (d) which infringes the patents, trademarks, trade secrets, copyright or other intellectual property rights of a third party.
In addition, you agree not to transmit, upload, email or otherwise make available any unsolicited or unauthorized viruses, advertisements, solicitations or promotional materials, including chain letters, mass emails or other forms of spam. In addition, the user agrees not to (i) assume the identity of any other natural or legal person, or falsely misrepresent or misrepresent their association with natural or legal persons; (ii) “to persecute” or otherwise harass, including by inciting harassment by others, to deceive or otherwise harm others, including minors; (iii) forge headers, or otherwise manipulate tools that identify the material, in order to disguise the origin of User Content; (iv) collect or store third-party user identification data.
LAV’S Srl does not recommend or control User Content transmitted or uploaded to the Site and therefore does not in any way guarantee its quality, integrity or correctness. You acknowledge that by using the Site, you may be exposed to User Content that is indecent, offensive or harmful to you. Under no circumstances shall LAV’S Srl be liable for any User Content, including without limitation errors or omissions in User Content, or for any loss or damage suffered by the User as a result of the use of User Content transmitted, uploaded, emailed or otherwise made available on the Site.
LAV’S Srl reserves the right (but not the obligation) to refuse to upload, or remove, or to modify, delete or retouch, at its sole discretion, any User Content. Without prejudice to the following provisions or any other provision of these Terms of Use, LAV’S Srl has the right to remove any User Content that violates these Terms of Use or that otherwise would be prejudicial, and to refuse to provide the service without notice to those users who transmit User Content to the Site in violation of the foregoing.
The user undertakes to indemnify LAV’S Srl from any prejudice or damage that may arise from the exercise of actions to protect rights in relation to User Content.

11. Warranties; Limitation of Liability
To the extent permitted by law, the Site is presented “as it is”. LAV’S Srl does not provide any guarantee in relation to these Terms of Use or the Site and excludes any guarantee or condition of any kind in relation to these Terms of Use or the Site.
You agree that, to the fullest extent permitted by law, LAV’S Srl will not be liable for (a) service interruption; (b) delays or interruptions in accessing the Site; (c) failure or misrepresentation of information, its destruction or other modification; (d) loss or damage of any kind resulting from the presence of hyperlinks on the Site to pages outside the Site; (e) viruses, system errors or malfunctions that may occur in connection with the use of the Site by the user, including malfunctions in connection with hyperlinks to or from third party websites; (f) any inaccuracy or omission in the content or (g) any event beyond its reasonable control.
Furthermore, to the maximum extent permitted by law, LAV’S Srl shall not be liable for damages in relation to the Site or its use by the user, regardless of whether LAV’S Srl may have been advised of the possibility of such damages.

12. Indemnification and compensation for damage
The user agrees to defend, indemnify and hold harmless LAV’S Srl from any damage, cost or other loss, including reasonable legal fees, that may arise from any legal action of third parties as a result of the use of the Site or the violation of these Terms of Use by the user. Furthermore, the user agrees to indemnify LAV’S Srl for any damage, cost or other loss, including reasonable legal fees, resulting from the use of spyware, crawlers or similar computer tools for collecting and extracting information, or from actions such as to place an unreasonable or excessive burden on the computer infrastructure of the Site.

13. Disputes
These Terms of Use are governed by Italian law and shall be construed in accordance with Italian law. Any dispute relating to the user’s visit to the Site will be referred to the mandatory jurisdiction of the place of residence or domicile of the user.

14. General clauses
You acknowledge and agree that these Terms of Use constitute the entire and exclusive agreement with LAV’S Srl regarding the manner of use of the Site and that such agreement supersedes any prior proposal, agreement or other communication in this regard.
LAV’S Srl reserves the right to modify these Terms of Use at any time, publishing any changes on the Site, and giving notice. Any change becomes effective immediately upon publication on the Site and disclosure of the notice of such change. The subsequent use of the Site by the user implies the consequent acceptance of the modifications to the Conditions of Use. LAV’S Srl may, upon notice, revoke the rights recognized under these Terms of Use. The user must immediately comply with any communication of this or any other type transmitted to him, possibly refraining from any use of the Site.
Nothing contained in these Terms of Use shall be construed as creating a relationship of agency, cooperation or other form of joint venture between you and LAV’S Srl. Failure by LAV’S Srl to exercise the rights provided for in these Terms of Use shall not affect the full possibility of asserting such rights subsequently, nor may it constitute a waiver of such rights by LAV’S Srl. If any provision of these Terms of Use is held to be invalid or unenforceable, these Terms of Use shall remain in full force and effect for the remainder and shall be supplemented in such a way as to reflect, as far as possible, the intentions underlying the provisions deemed invalid or unenforceable.
